Section I Basic Provisions
Article 1
- The name of the organization is the Czech Society for Psychoanalytic Psychotherapy.
- The organization's address is Brehová 3, 110 00 Prague 1. The organization is active in the Czech Republic.
- The Czech Society for Psychoanalytic Psychotherapy (hereinafter the CSPAP) is a volunteer citizen's special interest and educational association founded according to Law no. 84/90 Sb. dated March 27, 1990, on the right to free association.
- For the purposes of these statutes, psychoanalytic psychotherapy is understood as psychoanalytic psychotherapy with adults, groups, children and adolescents.
- For the purposes of these statutes, psychoanalytic psychotherapy is understood as a specific type of psychotherapy based on the psychoanalytic theories of various schools that acknowledge the existence of the unconscious, transference and counter-transference and, in one way or another, consider interpretation an important means of cure.
- For the purposes of these statutes, psychoanalytic therapy is understood as a specific type of therapy, the cost of which is covered by insurance companies in the Czech Republic or paid for by the patient himself.
Section II Mission and Aims of the CSPAP
Article 2
- The aim of the society is to aid the development of psychoanalytic psychotherapy and provide education and training in psychoanalytic psychotherapy.
- Its aim is, further, to establish, develop and maintain contacts with Czech and foreign societies with similar or identical aims or orientation.
- The society's aim is to establish
- criteria and rules for training in psychoanalytic psychotherapy which correspond to internationally recognized standards, as formulated on March 10, 1991 by the European Federation for Psychoanalytic Psychotherapy and its Applications to Health and Related Public Services, located in London;
- criteria and rules which will be in accordance with the appropriate resolutions of the Ministry of Health of the Czech Republic or national laws.
- Its aim is to defend the standards of education and training in psychoanalytic psychotherapy accepted by the European Federation as the minimum qualifications for practicing psychoanalytic psychotherapy, should the valid minimum national rules for training in and practice of psychoanalytic psychotherapy in the Czech Republic become less strict in the future.
- Its aim is to define ethical principles and binding rules for the practice of psychoanalytic psychotherapy in both the public and private sectors.
- Its aim is, further, to increase the level of information about psychoanalytic psychotherapy among professionals, in administrative bodies in the field of health and other fields and legislative institutions, and among the public.
- Its aim is, further, to support research on psychoanalytic psychotherapy.
- Its aim is to support communication between psychoanalytic psychotherapists and psychoanalysts in the Czech Republic as well as outside it, by means of publications, information bulletins, scientific conferences and other means of information and communication.
- Its aim is to become the guarantor of psychotherapeutic education in psychoanalytic psychotherapy in the Czech Republic, and to work together in this regard with the Ministry of Health of the Czech Republic and its educational institutions, the Czech Chamber of Physicians, the Czech and Moravian Association of Clinical Psychologists, the Society for Psychotherapy and Family Psychotherapy of the Czech Physicians' Society and any other professional organizations and associations, according to need.
Article 3
- For the purpose of carrying out and achieving the aforementioned aims, the Czech Society for Psychoanalytic Psychotherapy will:
- Create a central institution for acquiring, storing and disseminating information and knowledge concerning psychoanalytic psychotherapy and psychoanalysis and for training in psychoanalytic psychotherapy. This institution will carry the name of the Institute of Psychoanalytic Psychotherapy (IPP).
- Establish, perform, support, organize and finance studies and create, produce and circulate publications, periodicals and informational brochures in cooperation with the Institute of Psychoanalytic Psychotherapy.
- Propose, organize and oversee conferences, meetings, lectures, seminars and the like.
- Purchase, rent, receive or otherwise acquire real and movable property.
- Acquire funds through membership dues and educational, lecture or other activities.
Section III Membership in the CSPAP, members' rights and obligations
Article 4
- Membership in the CSPAP is divided into four levels:
- Regular membership may only be obtained by a person who has completed his education in psychoanalytic psychotherapy (education in psychoanalytic psychotherapy is defined under Section VI hereof) and has at least three years' practice in psychoanalytic psychotherapy.
- Non-regular membership is awarded to applicants who have completed their training in psychoanalytic psychotherapy.
- Guest membership is awarded to applicants who have not yet completed their training in psychoanalytic psychotherapy, or who are interested in psychoanalytic psychotherapy as professionals from a related field, or who contribute to the CSPAP's mission and activities through organizational, work or promotional activities or financially.
- Honorary membership is reserved for important personalities and representatives of psychoanalysis and psychoanalytic psychotherapy from the Czech Republic and abroad, and may not be requested.
- The conferring of all forms of membership is decided upon by vote at an assembly of regular members.
Article 5 Obligations of an individual member
- To adhere to the statutes of the CSPAP and respect their basic principles in his own activities.
- To pay membership dues on time and in the amount established by the CSPAP general assembly.
- To properly carry out the function to which he has been appointed within the CSPAP.
- To defend the interests and mission of the CSPAP and contribute to its good name in the Czech Republic and abroad through his own activities and actions.
- To actively assist in increasing the general and professional standards of other CSPAP members.
- To actively take part in general assembly meetings.
Article 6 Rights of regular and honorary members
- To take part in all CSPAP professional activities and make use of information, statements, judgements, expert opinions, professional publications and other services and benefits within the scope of the CSPAP's activities.
- To request information on CSPAP events and events of its partner organizations abroad.
- To submit proposals to organize professional or educational events or requalification courses within the CSPAP's sphere of activity.
- To request professional assistance within the CSPAP's sphere of activity.
- To make use of experience, knowledge and materials acquired from the CSPAP's international contacts.
- To elect members of the CSPAP executive committee.
- To submit proposals for changes to the CSPAP statutes.
Article 7 Rights of non-regular and guest members
- To take part in CSPAP activities to the extent defined for individual activities entrusted to them by regular members.
- To request information on CSPAP events and events of its partner organizations in the CR and abroad.
- To submit proposals to organize popularising and educational events for the public and members of related fields.
- To make use of professional assistance within the CSPAP's sphere of activity.
Section IV Structure of the CSPAP
- The CSPAP is divided into three sections: individual psychoanalytic psychotherapy for adults, group analytical psychotherapy, and psychoanalytic psychotherapy for children and adolescents.
- The individual sections are autonomous in forming their program of activities, within the framework of the CSPAP's aims and statutes. They do not, however, have the right to change the rules and requirements for training in the individual sections, but may submit proposals for changes in the training rules and requirements to the CSPAP's general assembly.
- Each section has its own coordinating committee, made up of three members of the CSPAP.
- The CSPAP executive committee is made up of seven functionaries, with each section represented by at least one elected member. The executive committee is elected for a term of two years by an assembly of the regular members of the CSPAP. The executive committee assigns tasks and functions to its own members according to needs connected with the management of the CSPAP. These functions are, in particular, those of the coordinator and his deputy, acting secretary and treasurer.
- The executive committee elects a coordinator from among its members for a term of one year. Representatives of the individual sections successively alternate in the role of coordinator.
- With regard to the selective character of the CSPAP and the low degree of dispersal of its members outside major urban centers, the CSPAP will not form any regional organizations or independent branches. The structure of the CSPAP consists of four differentiated membership levels, three sections and occasional working groups. An individual member may be a member of more than one section and working group.
- The inspector monitors the CSPAP's management of its movable and real property.
- The Institute of Psychoanalytic Psychotherapy (IPP) forms a special working group, providing the primary educational functions within the CSPAP.
Section V The CSPAP's Institute of Psychoanalytic Psychotherapy
Article 8
- The basic step towards foundation of the Institute of Psychoanalytic Psychotherapy will be the election of training psychotherapists in the individual fields of psychoanalytic psychotherapy. Their number will be determined by the CSPAP's executive committee, based on the number of applicants for training in psychoanalytic psychotherapy. Nominations for training therapists are put forward by regular members of the CSPAP, and their approval by a two-thirds majority of the assembled regular members forms the basis for the accreditation officially awarded to training therapists and their institutes by the Ministry of Health of the Czech Republic or any other entity appointed thereto by a valid resolution or law.
- Training psychotherapists elect a nine-member training committee from among their ranks, which will organize and implement educational and training programs with the aid of the other CSPAP training psychotherapists. The IPP training committee is responsible for properly implementing training programs and adhering to the rules and requirements for training in psychoanalytic psychotherapy.
- The CSPAP establishes the rules and requirements for training in psychoanalytic psychotherapy, which are then implemented and organized by the Institute of Psychoanalytic Psychotherapy.
- The clinical base of the Institute of Psychoanalytic Psychotherapy is the Psychotherapeutic Center (located at Břehová 3, Prague 1) and other independent psychotherapeutic, psychiatric and psychoanalytic institutes which demonstrate an interest, and whose professional and personnel composition make them suitable to serve as clinical bases for training in psychoanalytic psychotherapy.
- The economic activities of the Institute of Psychoanalytic Psychotherapy are managed and regulated by the CSPAP executive committee and the CSPAP inspector.
- The Institute of Psychoanalytic Psychotherapy has no independent legal status. The IPP training committee is subordinate to the CSPAP executive committee.
- The training committee, as well as the other CSPAP training psychotherapists, are sworn not to disclose the private matters of psychoanalytic psychotherapy candidates to other persons, including members of the CSPAP executive committee.
Section VI Assembly of regular members of the CSPAP
Article 9
- The highest authority within the CSPAP is the assembly of its regular members. The assembly is summoned by the executive committee as needed, at least once a year. In exceptional circumstances, it may be summoned by a simple majority of all regular members. A simple majority of all regular members must also be present in order for a given assembly to be properly empowered to elect functionaries (of the executive committee), to make modifications and changes to the statutes, and to be capable of carrying a resolution.
- The assembly of regular members of the CSPAP elects the executive committee and the inspector, in each case for a term of two years.
- The assembly of regular members of the CSPAP elects and recalls CSPAP training psychotherapists, confers regular and honorary membership based on proposals by the IPP training committee, and approves the acceptance of non-regular and guest members. It may also discuss other matters, for example proposals for activities by the central institution (the IPP) or the need to summon a general assembly of the CSPAP. However, it may not assume the authority of the IPP training committee in matters regarding the organization and implementation of training programs. An assembly of regular members of the CSPAP may take place independently or as a separate part of a general assembly meeting.
- The highest authority within the CSPAP between individual assemblies of its regular members is the CSPAP executive committee.
Section VII General Assembly
Article 11
The general assembly of all members of the CSPAP is summoned by the CSPAP executive committee, generally once every two years. The proceedings of the general assembly are concerned with the program and orientation of the CSPAP's activities, an analysis of its activities during the preceding period and other matters concerning the CSPAP's activities, including economic ones.
Section VIII Economic Managementí
Article 12 Economic management of the CSPAP
- The property of the CSPAP consists of real estate and financial resources. The CSPAP manages this property in accordance with generally binding legal regulations, and guarantees its financial obligations to other parties up to the full amount thereof.
- The CSPAP's income includes:
- Individual membership dues
- Income from its professional activities
- Income from economic and business activities
- Grants, subsidies and gifts from outside parties.
Article 13 Membership dues
The amount of membership dues and the method of their payment are established by the general assembly of the CSPAP.
Section IX Final Provisions
Article 14
- The CSPAP has legal status as a whole, and an assembly of regular members of the CSPAP may confer legal status to other bodies of the organization or special or economic facilities, and revoke the same.
- The activities of the CSPAP are governed by the executive committee, which is the highest authority within the CSPAP between individual assemblies of its regular members. The activities of the executive committee are governed by the resolutions of the assembly of the CSPAP's regular members.
- The coordinator of the executive committee, his deputy, the acting secretary and any other authorized members of the executive committee are entitled to act in the name of the CSPAP.
- These statutes may be changed only by a resolution of an assembly of regular members of the CSPAP. A two-thirds majority is required to approve such changes.
- These statutes become valid on the day that the CSPAP is registered with the appropriate state administrative body. They take effect on the date established by the executive committee of the CSPAP.
- A two-thirds majority of an assembly of regular members of the CSPAP may decide on the dissolution of the CSPAP.
